Homeowner purchased a home that was only 8 years old and had it repainted. A year later, the home suffered smoke damage when the gas fireplace malfunctioned.  Insurance company denied coverage, saying that the smoke damage was long-term damage, and it happened because the fireplace cover was a designed badly, at least according to the engineer the insurance company hired.  The insurance company joined the fireplace manufacturer, and the manufacturer hired another so-called “expert”. After extensive litigation, the insurance company and manufacturer realized they could not win and the homeowner was compensated for her loss.
